Terms of Use

These terms and conditions apply to LLCmarbleparetto(hereinafter referred to as "our company"), which operates A'sESSENTIALS (hereinafter referred to as "store"), provides kimono rental and related services (hereinafter referred to as "the service"), as well as the information provided on our website and these terms and conditions (collectively, "the terms and conditions"), and these terms and conditions are set out in this document. These terms and conditions are between our company and all users (hereinafter referred to as "users") who use our company.

1. Terms

1) You are deemed to have agreed to these Terms and Conditions by using this Service or our website, or by entering a store.
2) These terms and conditions, etc., are published on the Internet and you are deemed to have agreed to them even if you use a service other than our website, visit our store, or make a reservation by phone.
3) In the event of any trouble occurring regarding the Service, the parties shall negotiate in accordance with these Terms and Conditions, etc., and any matters not stipulated in these Terms and Conditions, etc. shall be resolved in accordance with laws and regulations, including the Civil Code.
4) This service is intended for personal enjoyment, and the kimonos provided by our company cannot be used commercially without our prior permission. If a user wishes to use the kimonos in this way, they must contact us at least five days before the reservation date, and our company will present the usage fee etc. according to the content of the use.
5) Accompanying persons who are not renting kimonos (friends or guardians in the case of minors) will not be allowed to enter the store.
6) This service is not available to pregnant women. If you do not inform us in advance that you are pregnant, we will not be held responsible for any trouble that may occur.

2. Reservations and Cancellations

1) A reservation made by a user through our website shall be deemed to have been made at the time when our company accepts the user's reservation application. The same shall apply even if the user or our company is unable to receive a notification of receipt of the reservation due to communication conditions or negligence on the part of our company or the user.
2) If a user wishes to cancel a reservation after it has been made, a cancellation fee of 50% will be charged if cancelled on the day before or after the date of use, and 100% will be charged if cancelled on the day of use.

3. Provision of Services

1) The dates and times of provision of the Service shall be as stated on our website, etc. If there are any changes to the dates and times of provision of the Service, we shall notify users in a manner that we deem appropriate.
2) The service fee is as stated on our website. The service fee may vary depending on the plan. Even if you make a reservation through our website, the service fee may vary depending on the selection made by the user when visiting the store. If the service fee changes, we will not provide prior notice.
3) Payment for this service shall be made in cash on the day of use.
4) If the item is not returned within business hours on the day of the service, an extension fee will be charged, as specified on our website, regardless of whether or not you have contacted us in advance by phone or other means. The extension fee will be paid in cash at the store.
5) This service cannot be provided and baggage cannot be stored or collected outside of the service hours.
6) In order to ensure the safety of users and our staff, if a heavy rain (landslide, flooding), flood, storm, snowstorm or heavy snow warning is issued within the city, ward or town where the store is located two hours prior to the opening time, the store will be closed and the service will not be provided. In this case, our company will not be held liable for any disadvantage suffered by the user.

4. Restrictions and Prohibitions on Use

1) We will prohibit users who fall under any of the following categories from using our stores, and will refuse to allow them to use our services even after a reservation has been made.

  1. A person who belongs to an organized crime group (hereinafter referred to as an "organized crime group") as defined in Article 3, Paragraph 77 of the Law Concerning Prevention of Unjust Activities by Organized Crime Group Members (Law No. 2 of 2; hereinafter referred to as the "Law"), or when it is deemed that the person is promoting the activities of an organized crime group or contributing to its operation.
  2. When a customer has engaged in intimidating behavior, such as violence, threats, or extortion, or has demanded an unreasonable burden from a store or employee, or when a customer is deemed to have engaged in similar behavior in a store in the past, regardless of whether the store was operated by our company or not.
  3. When there is a risk of causing significant inconvenience to other users, or when a user has behaved in a manner that causes significant inconvenience
  4. When you are excessively intoxicated.
  5. If you are clearly infected with an infectious disease or have any other disease that may be contracted through infection.
  6. When the contents of the reservation/contract (purpose of use) differ from that at the time of application and a clearly false application is made
  7. When you refuse to agree to these Terms, etc., or when the Company determines that you are in violation of these Terms, etc.
  8. Any other case that is deemed to be in violation of laws, regulations, or public order and morals.
  9. Our company reserves the right to ask any user who commits any of the prohibited acts specified by our company to leave the store, and to claim damages if such prohibited acts cause damage to our company.

2) We will not accept any of the following items:

  1. Items that are longer or heavier than the standard range of carry-on baggage
  2. Cash and valuables (passports, cash, driver's licenses, ID cards or items that prove identity, equivalents, house and car keys, expensive clothing, bags, jewelry, watches, credit cards, cash cards, rare items or items with high market value, etc.)
  3. Expensive precision equipment (PCs, digital cameras, game consoles, tablets, etc.)
  4. Items that are explosive, flammable, or otherwise dangerous
  5. Fresh foods, frozen products, refrigerated products, fruits and vegetables, fresh flowers, items that leak water or are easily spoiled
  6. Anything that goes against public order and morals (narcotics, dangerous drugs, etc., the use of which is prohibited by law)
  7. Items that have objectively or subjective value that cannot be covered by monetary compensation from our company, such as mementos or gifts.
  8. Items that are easily broken or deformed
  9. Items that do not fall under the above categories but that we have determined would be difficult to accept
  10. Notwithstanding the preceding paragraph, if the User wishes to leave the items listed in the preceding paragraph with our company, the User agrees in advance that our company shall not be liable for any loss (including theft), damage, water leakage, or other damage to such items.

5. Items left behind by users

1) If a user leaves behind an item in our store, it will be handled as follows and the user agrees to this in advance.

  1. Valuables will be delivered to the nearest police station. If the customer contacts us before we deliver the items to the police station, we will return them to the store. Items will not be returned by mail.
  2. For items left behind other than valuables, if we do not receive any contact from the user within one week of the date of discovery, we will assume that the ownership has been abandoned and will dispose of the item. If we receive contact from the user within the aforementioned period, the item will be returned by cash on delivery mail. The shipping date will be determined at our convenience.

6. Disclaimer

1) We shall not be liable for any direct or indirect disadvantage suffered by a user or a third party in connection with this service due to the following reasons.

  1. When there is a delay in providing the Service due to congestion or other reasons.
  2. When the Company is unable to provide the Service to Users due to circumstances beyond its control, such as bad weather, disasters, wars and conflicts, traffic restrictions due to events, outbreaks of epidemics, or other reasons that require the Company to close or change its business hours
  3. When a product image posted by the Company on its website is unavailable due to stock status, etc.
  4. When the kimono, how it is worn, hair styling, etc. differ from what the user expected due to their preferred values.
  5. When skin irritation, nausea, infections, etc. occur due to commercially available detergents (including commercial use), alcohol, or disinfectants and deodorants.
  6. When an accident occurs to the user's body or property due to moving the body beyond the normally expected range during treatment such as dressing or hair styling.
  7. When an accident occurs to the user's body or property within the store, not due to the Company's intentional or gross negligence
  8. When other damage occurs through no fault of our company

2) We assume that the luggage stored by the user is clothing. We are not responsible for the loss or damage of items caused by the following reasons:

  1. When the customer fails to declare that the item specified in 5-2) of these Terms and Conditions is included
  2. When handled with the same care as clothing.
  3. When minor damage occurs (scratches, cuts, dents, dirt)
  4. When a user mistakes their checked baggage for that of another user
  5. When loss or theft occurs despite the fulfillment of the administrator's duties
  6. When loss or damage occurs due to fire, natural disaster, war or conflict
  7. When any other loss or damage occurs through no fault of our company

3) Even if the use of this service causes damage to a user or a third party and the Company is liable for compensation, the liability for compensation will be limited to the actual amount of loss, and the Company will not be liable for any secondary damages (including internal data in electronic devices) or lost profits.
4) The amount of compensation for damages incurred during baggage storage will be limited to 1 yen (tax included) per piece of baggage.

7. Changes to Terms

1) We may change these Terms and Conditions, etc. as necessary within the scope of the purpose of the Service.
2) If the Company changes these Terms, etc., the revised content and the effective date will be posted in these Terms, etc. or on its website, or will be notified to users by a method that the Company deems appropriate, and the revised Terms, etc. will come into effect as from the effective date.

8. Governing Law and Jurisdiction

1) The terms and conditions shall be governed by the laws of Japan.
2) In the event of a dispute arising from the use of the Service, the User and the Company shall attempt to resolve the dispute in good faith, and if the dispute cannot be resolved in that manner, the Tokyo District Court shall be the court of exclusive jurisdiction.
